Premium Direct Messaging Terms of Service

These Premium Direct Messaging Terms of Service ("Premium DM Terms") supplement the general Terms of Use and constitute a binding agreement between you ("User," "you," or "your") and JobSite Recon LLC, a New York limited liability company ("JobSite Recon," "we," "us," or "our"). By accepting these terms, you acknowledge that you have read, understood, and agree to be bound by these Premium DM Terms in addition to all other applicable terms and policies. Access to Premium Direct Messaging features is contingent upon your acceptance of these terms.

1. Purpose and Permitted Use of Direct Messaging

The Premium Direct Messaging feature ("DM Feature") is provided exclusively for the purpose of facilitating professional communication between verified Premium members regarding jobs, quotes, business opportunities, and general professional coordination between contractors and trades. Permitted uses include:

• Discussing a specific job, quote, or business opportunity
• Coordinating logistics, scheduling, or follow-up work between contractors
• General professional networking between verified Premium members

The DM Feature is not intended for general social conversation, solicitation, advertising, recruitment, or any purpose unrelated to professional trade work and job coordination. The DM Feature may not be used to elaborate on, explain, provide additional context for, or discuss the substance of any rating submitted on the Platform — see Section 2.4 below.

2. Prohibited Content and Conduct

You agree that you will not transmit, share, or attempt to share any of the following through the DM Feature. Violations will result in immediate content removal and may result in permanent account suspension:

2.1 Personally Identifiable Information (PII)

You may not share any personally identifiable information through direct messages, including but not limited to:

• Phone numbers (personal, business, or otherwise)
• Email addresses
• Social Security numbers or taxpayer identification numbers
• Driver's license or state identification numbers
• Credit card, debit card, or bank account numbers
• Home addresses or precise personal locations
• Any other information that could be used to identify, contact, or locate an individual outside of the Platform

All communication between Premium members must remain within the Platform. Attempts to circumvent this restriction by encoding, obfuscating, or creatively formatting prohibited information (e.g., spelling out numbers, using spaces or symbols to break up phone numbers) are also violations of these terms.

2.2 Hate Speech, Racial Slurs, and Discriminatory Language

JobSite Recon has a zero-tolerance policy for hate speech, racial slurs, religious bigotry, or any form of discriminatory language. This includes, but is not limited to:

• Racial or ethnic slurs, epithets, or derogatory terms targeting any race, ethnicity, or national origin
• Anti-religious hate speech, slurs, or derogatory commentary targeting any religion, faith, or belief system
• Homophobic, transphobic, or other slurs targeting sexual orientation or gender identity
• Any language intended to demean, dehumanize, or incite hatred against individuals or groups based on protected characteristics including race, color, religion, national origin, sex, sexual orientation, gender identity, disability, or veteran status

JobSite Recon does not endorse, condone, or tolerate racial hatred, religious bigotry, or any form of discriminatory conduct. Any user found to be in violation of this policy will be permanently banned from the Platform without refund.

2.3 Threats, Criminal Activity, and Illegal Content

You may not use the DM Feature to engage in, facilitate, promote, or discuss any criminal activity. Prohibited content includes, but is not limited to:

• Threats of violence, bodily harm, or death against any person
• Intimidation, harassment, stalking, or bullying
• Solicitation or conspiracy to commit any crime
• Discussion of or instructions for creating weapons, explosives, or harmful devices
• Content related to child exploitation or child sexual abuse material (CSAM)
• Content promoting terrorism, extremism, or radicalization
• Fraud, identity theft, phishing, or social engineering attempts
• Drug trafficking, solicitation for controlled substances, or promotion of illegal drug use
• Any content that violates federal, state, or local law

JobSite Recon does not endorse or tolerate criminal activity of any kind. Any user found engaging in or promoting criminal conduct through the Platform will be permanently banned and reported to the appropriate authorities.

2.4 Rating-Related Circumvention

You may not use the DM Feature to:

• Elaborate on, explain, or provide additional context for a rating you or another user has submitted on the Platform
• Solicit the removal, modification, or reaffirmation of a rating outside the formal dispute process described in the Terms of Use
• Pressure, negotiate with, or offer anything of value to another user in connection with a rating they submitted or a rating submitted about them

3. Automated Content Monitoring and Moderation

By using the DM Feature, you acknowledge and consent to the following:

• All direct messages are subject to automated content screening. Messages containing prohibited content as described in Section 2 will be automatically detected, flagged, and removed. The original message content will be replaced with a notice indicating a Terms of Service violation.
• All direct messages may be monitored, reviewed, and stored by JobSite Recon. We reserve the right to review message content at any time, for any reason, including but not limited to investigating reported violations, responding to legal process, or ensuring compliance with these terms.
• You should have no expectation of privacy in the content of messages sent through the DM Feature beyond what is described in our Privacy Policy.
• Automated screening may, in rare cases, flag content that does not actually violate these terms. If you believe a message was incorrectly flagged, you may contact us, but we are under no obligation to restore flagged content.

4. Law Enforcement Cooperation

JobSite Recon will fully cooperate with all federal, state, and local law enforcement agencies in connection with any investigation arising from the use of the DM Feature. This cooperation includes, but is not limited to:

• Responding to valid subpoenas, court orders, search warrants, and other legal process
• Voluntarily reporting suspected criminal activity, including threats of violence, terrorism, child exploitation, and fraud, to appropriate law enforcement agencies
• Preserving and producing message records, user information, IP addresses, device information, and other relevant data as required by law or as we deem necessary to protect public safety
• Cooperating with the FBI, Department of Homeland Security, New York State Police, local police departments, and any other law enforcement entity with jurisdiction

We may disclose your information to law enforcement without prior notice to you if we believe in good faith that such disclosure is necessary to prevent imminent harm, address suspected criminal activity, or comply with legal obligations.

5. Enforcement and Penalties

Violations of these Premium DM Terms will be addressed as follows:

• First violation: The offending message will be automatically removed and replaced with a violation notice. The user will be warned.
• Repeated violations: The user's account may be suspended or permanently banned from the Platform at JobSite Recon's sole discretion.
• Severe violations (threats, criminal activity, hate speech, CSAM): Immediate permanent ban and referral to law enforcement where appropriate. No refund will be issued.

JobSite Recon reserves the right to determine, in its sole discretion, whether any content or conduct violates these terms.

6. Indemnification

You agree to indemnify and hold harmless JobSite Recon LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the DM Feature, your violation of these Premium DM Terms, or your violation of any law or rights of any third party.

7. Limitation of Liability

JobSite Recon is not responsible for the content of messages sent between users. While we employ automated screening to detect and remove prohibited content, no automated system is perfect. JobSite Recon shall not be liable for any damages arising from messages that are not detected by our screening systems, nor for any damages arising from messages that are incorrectly flagged.

8. Modifications

We reserve the right to modify these Premium DM Terms at any time. Material changes will be communicated through the Platform. Your continued use of the DM Feature after any modifications constitutes acceptance of the revised terms. If you do not agree to modified terms, you must discontinue use of the DM Feature.

9. Governing Law

These Premium DM Terms shall be governed by and construed in accordance with the laws of the State of New York without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved exclusively in the state or federal courts located in the State of New York.
